A lot of people have too much fun at big games like the Super Bowl. They over extend themselves, they drink too much, they eat too much, they don’t get enough to rest, and with the weather down here today they might feel the need to stay warm. This again can result in people drinking to much, maybe vomiting or passing out in the bathroom stall at the bar or even the table. All the friends are having a great time and you find yourself playing “rock, paper, scissors” to determine who takes them home. Then someone has the great idea to leave them in the car.
Guys, not a great idea! First of all its way too cold for someone to be left alone in a car unattended and it’s not safe, second there may be a liability concern if the person has had so much to drink that they risk alcohol poisoning or other health risks, and third, although not all encompassing they risk a public intoxication ticket. Texas Penal Code Section 49.02 defines public intoxication as (a) A person commits an offense if the person appears in a public place while intoxicated to the degree that the person may endanger the person or another. So if you leave your friend in the car and an officer pulls up, among other potential liability risks and concerns, the officer could give your passed out friend a ticket for public intoxication and even worse than paying the fine…they will probably miss the Super Bowl and likely you will too because they might be sleeping it off in a drunk tank and you might be going to pick them up at the jail when they are done.
Call a cab, don't drink and drive, and watch out for your friends. Remember to always drink responsibly!
